1. Agreement to these terms

These Terms & Conditions govern your use of the HibiNex Android app, the HibiNex Windows app, and this website (together, "HibiNex"). By installing or using HibiNex you agree to them. If you do not agree, do not use HibiNex.

Our Privacy Policy forms part of these terms.

2. Who we are

HibiNex is developed and operated by Jibran, an independent developer based in India. In these terms, "we", "us" and "our" refer to Jibran. You can contact us at support@hibinex.com.

3. What HibiNex does

HibiNex sends the audio your phone is playing to a Windows PC on the same local network, so both can be heard through one pair of headphones connected to the PC.

To work, it requires all of the following. These are conditions of the product functioning, not promises we can make on your behalf:

• Both the Android app and the Windows app installed and running.
• Your devices on the same local network, or on a hotspot shared between them.
• A network configuration that permits them to reach each other. Some networks — guest Wi-Fi, corporate networks, and networks with client isolation enabled — deliberately prevent this, and HibiNex cannot work on them.

HibiNex copies audio; it does not move it. Your phone continues playing sound through its own speaker unless you turn its volume down.

4. Your licence to use HibiNex

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use HibiNex on devices you own or control, for your own use.

You may not:

• sell, rent, sublicense or redistribute HibiNex, or charge others for access to it;
• reverse engineer, decompile or disassemble the apps, except to the extent that applicable law expressly permits despite this restriction;
• remove or obscure any notice of ownership, or attempt to circumvent the advertising the free app depends on;
• use HibiNex to build a competing product, or present it as your own.

5. Acceptable use

You are responsible for what you play through HibiNex. In particular:

• Use HibiNex only with audio you have the right to play and to route to your own equipment.
• Do not use HibiNex to capture, retain or redistribute copyrighted material in breach of the rights of others, or to circumvent copy protection.
• Some apps mark their audio as protected, and Android will not allow it to be captured. Do not attempt to defeat that protection.
• Do not use HibiNex to record other people without the consent required by your local law.
• Do not use HibiNex for any unlawful purpose, or to interfere with networks or devices you do not control.

HibiNex does not save audio to a file at any point. It plays the sound and discards it.

6. Advertising

The Android app is free and is funded by ads served through Google AdMob. The Windows app contains no advertising.

We do not control which ads are shown. What data Google processes to serve them, and the choices available to you, are set out in our Privacy Policy.

7. App stores and third-party services

HibiNex is distributed through Google Play and the Microsoft Store. Your download and use are also subject to those stores' own terms, and each store — not us — handles matters such as installation, refunds and account issues on its platform.

HibiNex is not affiliated with, endorsed by, or sponsored by Google LLC or Microsoft Corporation. Android and Google Play are trademarks of Google LLC. Windows and Microsoft Store are trademarks of Microsoft Corporation.

The apps include third-party open-source components. Their licences are listed in the Android app under Settings → Open-source licenses, and in the Windows app under About.

8. Availability and changes

We may update, change or discontinue HibiNex, or any part of it, at any time. We may release updates that change how features behave. We are not obliged to maintain backwards compatibility between versions of the phone and PC apps, and you may need to update both to keep them working together.

Because HibiNex runs entirely on your own devices and network, its availability depends on your hardware, your network and your operating systems — none of which we control.

9. Disclaimer of warranties

HibiNex is provided "as is" and "as available", without warranty of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that HibiNex will be uninterrupted, error-free, or free of audio dropouts or delay. Live audio over a wireless network is affected by interference, network congestion, device performance and power-management behaviour, all of which sit outside our control.

Nothing in this section limits any warranty or guarantee that cannot be excluded under the law that applies to you as a consumer.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, loss of profits, or loss of use, arising out of or relating to your use of or inability to use HibiNex.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to HibiNex is limited to the amount you have paid us for it — which, for a free app, is nil.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your statutory rights are unaffected.

11. Termination

You may stop using HibiNex at any time by uninstalling it. We may suspend or terminate your licence if you materially breach these terms. Sections 9, 10, 12 and 13 survive termination.

12. Intellectual property

HibiNex, including its software, name, logo and this website, is owned by Jibran and protected by intellectual property law. These terms grant you a licence to use HibiNex; they do not transfer any ownership to you.

13. Governing law

These terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts of Telangana, India shall have jurisdiction over any dispute arising from them.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection rules of the country in which you live, or of the right to bring proceedings there where local law grants it.

14. Changes to these terms

We may revise these terms from time to time. The "Last updated" date at the top of this page shows when they last changed. Continuing to use HibiNex after a change means you accept the revised terms. If a change is significant, we will make it clear in the app or on this site.
